Title: Authorizes Developers to Levy Property Taxes

Vote to concur with Senate amendments and pass a bill establishes requirements for the creation and governance of community facilities districts.

Highlights:

 

  • Requires the governing body of a district to adopt a resolution in order to form a community facilities district that includes contiguous or noncontiguous property if the land proposed to be included in the district is more than 600 acres (Sec. 2).

  • Specifies that noncontiguous property may only be included in a district if it is under common ownership or control and would be served by common infrastructure (Sec. 2).

  • Requires property owners to sign an agreement stating that they will not hold the governing body liable for any challenge or proceeding related to the offer, sale, and repayment of the district’s bonds and the levying by the district of any tax, assessment, or charge (Sec. 2).

  • Requires the property to meet the following requirements (Sec. 2):

    • The zoning allows development in excess of 1 residential dwelling unit per acre;

    • The property must be included within the planning area of a municipality; and

    • The property must be the subject of a specific plan that is approved by the county.

  • Requires certain property owners to make an agreement with a county regarding surface maintenance of public roadways to be financed by the district for a period of 3 years, which can be terminated if the county approves a new funding source (Sec. 9).

  • Requires certain property owners to make an agreement with law enforcement to provide police services to that property if it is not located within 10 miles of a sheriff substation (Sec. 9).
