Title: Fix Gun Checks Act of 2016

Vote on a motion to invoke cloture on an amendment to HR 2578 that amends the background check system for gun purchases.

Highlights:

  • Establishes that within 1 year, the Attorney General with the coordination of the states to implement a records recording system plan, made available to the National Instant Criminal Background Check System.

  • Requires that each such plan shall include the following annual benchmark goals in order to enable the Attorney General to assess implementation of the plan (Title VI, Sec. 611):

    • A qualitative goal; and

    • Quantitative measures.

 

  • Amends HR 2578 by adding “adjudicated as a mental defective” to the bill text (Title VI, Sec. 613).

  • Prohibits an individual who has been “adjudicated as a mental defective” from applying for relief from disability in the 180 days prior to the enactment of this act (Title VI, Sec. 613).

  • Prohibits any non licensed manufacturer or dealer from transferring a firearm to any other person who is not licensed (Title VI, Sec. 622).

NOTE: INVOKING CLOTURE REQUIRES A 3/5 MAJORITY OF THE SENATE. IT IS NOT A VOTE ON THE PASSAGE OF THE PIECE OF LEGISLATION, BUT LIMITS FURTHER DEBATE TO 30 HOURS. CLOTURE IS TYPICALLY USED TO END A FILIBUSTER. A FAILED CLOTURE VOTE OFTEN PREVENTS THE LEGISLATION FROM EVER COMING TO A VOTE.
