Title: Prohibits Donation of Fetal Tissue

Vote to pass a bill that prohibits the donation of fetal tissue.

Highlights:

  • Prohibits an individual from donating fetal organs or tissue resulting from an abortion to another individual or entity for medical, scientific, experimental, therapeutic, or any other use (Sec. A).
  • Exempts utilizing fetal tissue for certain medical purposes, including to determine the cause of an anomaly, illness, death, or genetic condition of the fetus, the paternity of the fetus, or for law enforcement purposes (Sec. A).
  • Requires each specimen to be tracked from the abortion facility to the pathology lab and to its final disposition location (Sec. A).
  • Requires a hospital, medical research entity, disposal facility or any other facility involved in handling fetal remains to implement a written policy regarding protections for employees who disclose information about violations of this bill (Sec. A).
  • Specifies that such a policy shall include the following provisions (Sec. A):
    • Prohibits a supervisor from preventing an employee from disclosing information;
    • Prohibits a supervisor from penalizing an employee that has disclosed information; and
    • Establishes a program to designate compliance officer to investigate a report.
  • Authorizes an individual who discloses information to remain anonymous (Sec. A).
  • Specifies that any individual who violates the provisions of this bill is guilty of a class C felony, with an optional fine of at least twice the amount of any valuable consideration received (Sec. A).
  • Specifies that inspection, investigation and quality assurance reports shall be made available to the public (Sec. A).
