Title: Establishes Prescription Drug Monitoring System

Vote to pass a bill that establishes prescription drug monitoring system.

Highlights:

  • Establishes a program to monitor the prescribing and dispensing of Schedule II, III, and IV controlled substances by a licensed professional (Sec. A).
  • Requires a “dispenser” to report certain information within 24 hours of dispensing a Schedule II, III, or IV controlled substance including, but not limited to, the following information (Sec. A):
    • The date and quantity of the prescription;
    • Whether the prescription is new or a refill; and
    • The patient’s name, address, date of birth and identification number.
  • Defines “dispenser” as an individual who delivers Schedule II, III, or IV controlled substances to a patient, excluding the following distributors (Sec. A):
    • A hospital that distributes the substances for the purpose of inpatient care or dispenses prescriptions for such substances upon discharge from the hospital;
    • A practitioner who administers such a substance; and
    • A wholesale distributor of Schedule II, III, and IV controlled substances.
  • Establishes a fine of $1,000 for a dispenser who knowingly submits incorrect dispensation information or fails to submit dispensation information (Sec. A). 
  • Authorizes an individual whose dispensation information has been unlawfully disclosed to bring a civil action for damages and injunctive relief in a circuit court (Sec. A).
