Title: Requires Schools to Use Teacher Performance Evaluations

Vote to pass a bill that prohibits layoffs based on seniority and requires schools to instead use teacher performance evaluation, effective June 30, 2015.

Highlights:

  • Prohibits a school from suspending, reinstating, or realigning a professional employee based on seniority except in the following circumstances (Sec. 3):
    • When more than 1 professional employee receives the same performance rating;
    • When a professional employee receives a performance rating of “proficient” or; 
    • When a professional employee receives “distinguished” on his or her most recent end-of-year performance evaluations.
  • Authorizes a school to suspend, reinstate, and realign a professional employee based on economic reasons except when the following conditions apply (Sec. 2):
    • A professional employee has received an overall performance rating of “distinguished” in the last 2 of the 3 most recent end-of-year performance ratings; and
    • A professional employee termination consideration is due to the employee’s compensation.
  • Specifies that a professional employee who receives a performance rating of “failing” on his or her most recent end-of-year performance rating will be suspended first, and those receiving “needs improvement” will be suspended second (Sec. 3).
  • Specifies that when more professional employees receive the same end-of-year performance rating, seniority within the school entity is used to determine suspension (Sec. 3).
