Highlights:

  • Establishes driving privilege cards for individuals who meet the requirements for a Class D license except for legal presence in the United States and who have met 1 of the following requirements during the past 2 years (Sec. 1):
  • The individual has filed a Delaware income tax return; or
  • The individual has resided in Delaware and been claimed as a dependent on a Delaware income tax return.
  • Specifies that a driving privilege card is not a valid form of identification and is to be designed to bear the phrases “Driving Privilege Only” and “Not Valid For Identification” (Secs. 1 & 3).
  • Requires an applicant to provide acceptable identification, including fingerprints and an affidavit confirming identity to the State Bureau of Identification for the purpose of a criminal background check (Sec. 4).
  • Specifies that all personal information collected from an applicant is confidential unless the background check finds a potential threat (Sec. 1).
