Highlights:

  • Prohibits the lead agency of a project from using the “social cost of carbon” in an environmental review required by the National Environmental Policy Act (NEPA) of 1969 (Sec. 2).
  • Defines “social cost of carbon” as an estimate of the monetized damages associated with an incremental increase in carbon dioxide emissions in a given year including, but not limited to, a change in agricultural productivity, human health, and property damages (Sec. 2).
  • Prohibits a lead agency from preparing more than 1 environment impact statement and 1 environmental assessment for a federal project (Sec. 2).
  • Requires a lead agency to complete certain NEPA documents for a federal project by the following deadlines (Sec. 2):
    • An environmental impact statement is due within 2 years of the project application; and
    • An environmental assessment is due within 1 year of the project request.
  • Requires a claim for judicial review of an action under NEPA to be filed within 180 days after the Federal Register gives public notice of the action (Sec. 2).
