Title: Limits School Disciplinary Policies

Vote to pass a bill that limits school disciplinary policies, effective July 1, 2015.

Highlights:

  • Limits the use of out-of-school suspension or expulsion for a student who is in fifth grade or lower to the following circumstances (Sec. 1):
    • When non-accidental conduct causes harm to a student or employee;
    • When a school administrator determines, based on an employees’ report, that the student’s conduct poses a direct threat to the health or safety of students or school employees; or
    • When suspension or expulsion is required by law.
  • Requires a school district to take preventative steps to reduce recurring behavior, in fifth grade students or below, that led to an out-of-school suspension (Sec. 1).
  • Establishes the following calculation for determining the number of school days a student has missed (Sec. 1):
    • A half day, if the student is out of school half or less than half of the school day; and
    • A full day, if the student is out of school for more than half of the school day.
