Vote to adopt a conference report that authorizes public-private partnership of hospital facilities.

Highlights:

  • Requires the following individuals to negotiate with a “private entity” to transfer the right and responsibility to manage, operate and provide health care services at one or more facilities of the Maui regional system (Sec. 2):
    • The governor; 
    • The chief executive officer of the Hawaii Health Systems Corporation; and 
    • The regional chief executive officer of the Maui regional system.
  • Defines “private entity” as a business organization authorized to operate 1 or more licensed hospitals in the state (Sec. 2).
  • Requires the Hawaii Health System Corporation and representative unions to meet and discuss the impact of a transfer on the employees and the possibility of decreasing the effect of layoffs by amending the employees’ collective bargaining agreements (Sec. 2). 
  • Requires the private entity to offer employment to all employees of the pre-transfer facility for a period of no less than 6 months after the transfer completion date (Sec. 2). 
  • Authorizes a private entity to request funding from the state for the operating costs of a transferred facility for each or all of the first 10 years of the lease (Sec. 2). 
  • Specifies that a request for funding will not exceed the amount appropriated for operating costs of the Maui regional system for the fiscal year 2014 (Sec. 2).
  • Specifies that after an initial 10 year period leasing the nonprofit and private entities will be responsible for all capital expenditures of the transferred facilities (Sec. 2).
  • Requires the Hawaii Health System Corporation to enter into a fixed-term lease with the private entity to rent the real property, including all improvements and fixtures on the property, of the transferred facilities (Sec. 2).
