Title: Prohibits Sale of Electronic Cigarettes to Minors

Vote to pass a bill that prohibits the sale of "inhalant delivery systems" to individuals under 18 years of age.

Highlights:

  • Prohibits the sale or distribution of an “inhalant delivery system” to an individual younger than 18 years of age (Sec. 1).
  • Defines “inhalant delivery system” as a device which an individual inhales from to ingest nicotine or cannabinoids in the form of vapor or aerosol, or a component or substance that is sold to be used with such a device (Sec. 1).
  • Prohibits the sale or distribution of an inhalant delivery system if it is packaged in a manner that is attractive to minors, unsealed, not packaged in child-resistant packaging, or improperly labeled. (Sec. 1). 
  • Prohibits an individual under 18 years of age from possessing an inhalant device system unless all of the following guidelines have been met (Secs. 7 & 8):
    • The individual is in a private residence;
    • The individual is accompanied by a parent or guardian; and
    • The individual’s parent or guardian has given consent to the individual to possess an inhalant delivery system. 
  • Prohibits the use of an inhalant delivery system in a public place or place of employment (Sec. 15).
  • Authorizes the Oregon Health Authority to impose a civil penalty between $250 and $1,000 for each violation of the provisions of this bill (Sec. 2).
  • Appropriates the money collected from violations of the provisions of this bill to the Oregon Health Authority Fund (Sec. 2).
  • Prohibits an individual from using an inhalant delivery system in a motor vehicle while a minor is present (Sec. 12).
