Title: Amends Local Municipalities' Ability to Regulate Oil and Gas Production

Vote to pass a bill that amends local municipalities' ability to regulate oil and gas production within their geographical boundaries, effective immediately.

Highlights:

  • Authorizes a local municipality to pass an ordinance to regulate oil and gas operations concerning, but not limited to, the following capacities (Sec. 1):
    • Road use;
    • Odors incidental to oil and gas production; and
    • Fencing and set back requirements for has and well site locations.
  • Prohibits local municipalities from passing an ordinance to regulate oil and gas operations including, but not limited to, the following operations (Sec. 1):
    • Drilling;
    • Fracture stimulation; and
    • Secondary recovery operations. 
  • Specifies that oil and gas operations not regulated by local municipalities are subject to the exclusive jurisdiction and regulation of the Oklahoma Corporation Commission (Sec. 1).

 

NOTE: A BILL WITH AN EMERGENCY CLAUSE REQUIRES A SEPARATE TWO-THIRDS VOTE OF THE LEGISLATURE FOR THE CLAUSE TO PASS. IF THE CLAUSE IS PASSED, THE BILL GOES INTO EFFECT IMMEDIATELY UPON THE GOVERNOR'S SIGNATURE.
