Title: Exempts Certain Public Officials from Late Filing Fees

Vote to adopt a conference report that exempts certain public officials from late fees, fines, and civil penalties due to non-compliance with required filings.

Highlights:

  • Authorizes the State Ethics Commission to exempt elected county officials, elected members of a local board of education, and elected municipal officials from fees and fines regarding late, incomplete or unfiled campaign disclosure reports that were due between January 1, 2014 and January 10, 2014, under the following circumstances (Sec. 19):
    • If the official submits a written request to the commission; or
    • If the official responds to a notification by the commission alleging noncompliance.
  • Authorizes a candidate for public office who was subject to late fees based upon alleged noncompliance with required filings between January 1, 2010 and January 10, 2014 to submit a written request to the commission for a waiver or refund of late fees (Sec. 19).
  • Requires an individual to pay outstanding late fees, fines, or penalties from a previous election before being eligible for party nomination if the candidate has been notified via written notification by the Secretary of State (Sec. 1).
  • Requires an individual’s request or response to be filed no later than December 15, 2015 (Sec. 19).
