Title: Limits Driver's Licenses for Foreign Nationals

Vote Smart's Synopsis:

Vote to pass a bill that requires a foreign national to provide proof of authorized entry into the country in order to obtain a driver's license, beginning July 1, 2015.

Highlights:

  • Requires a foreign national applying for a driver’s license or identification card to provide proof of his or her authorized period of admission into the United States (Secs. 1 & 6).
  • Requires a foreign national applying for a driver’s license or identification card to provide his or her unique identifying number from certain documentation, including, but not limited to, the following documents (Secs. 1 & 6): 
    • A valid passport;
    • A valid visa;
    • A valid permanent resident card; or
    • A valid employment authorization card issued under the applicant’s deferred action status.
  • Requires a foreign national applying for a driver’s license to provide the expiration date of his or her authorized period of admission into the United States (Sec. 1).
  • Requires a foreign national who seeks to renew his or her driver’s license or identification card to provide valid documentary evidence that his or her authorized status or period of admission is still in effect (Secs. 3 & 8). 
  • Specifies that a foreign national’s driver’s license or identification card immediately becomes void upon the expiration of the individual’s authorized period of stay in the country or if the individual is no longer approved for deferred action (Secs. 3 & 8). 
  • Requires a foreign national’s driver’s license or identification card to expire on 1 of the following dates, whichever occurs first (Secs. 3 & 8):
    • 30 days after the individual’s 21st birthday, if the license was issued prior to their 21st birthday;
    • 30 days after the individual’s 75th birthday;
    • 30 days after the individual’s birthday which occurs 4 years after issuance of the license;
    • 30 days after the individual’s birthday which occurs 8 years after issuance of the license, if the individual opted for this and qualified at the time of application; 
    • The day that the individual’s authorized period of admission ends; or
    • 1 year after the license’s effective date if the last day of an individual’s authorized admission period cannot be determined.
  • Classifies the intentional use of false information in any application for a driver’s license or identification card as a felony (Secs. 10 & 11). 
  • Classifies the transference of an instruction permit, driver's license, or provisional license to an individual who is not lawfully entitled to that document as a fourth degree felony (Sec. 11). 
  • Prohibits the use of a driver’s license as a valid form of identification outside of the state if it was issued to a foreign national without a social security number of proof of authorized presence in the United States (Sec. 12).
