  • Establishes a 5-tier registry for offenders of certain sexual and violent crimes, utilizing a “risk-based registration level”, with level 1 being the least risky and level 5 being the most risky (Sec. 1).
  • Defines “risk-based registration level” as a 5-tier risk categorization of offenders based on psychosexual evaluations performed by a certified evaluator and the severity of the crime committed (Sec. 1). 
  • Defines a “default level 5 registration” as the default registration level for an offender convicted of certain crimes, including, but not limited to, the following crimes (Sec. 1):
    • Committing ritualized abuse of a child;
    • Committing first degree kidnapping for the purpose of rape;
    • Committing murder in perpetration of rape; or
    • Committing a lewd act upon a child under the age of 16.
  • Defines a “default level 4 registration” as the default registration level of an offender who has not been reviewed by the board, does not meet the requirements of a default level 5 offender, or for an offender that received a risk-based designation, and then is subsequently convicted of a felony nonsexual offense (Sec. 1).
  • Requires a convicted offender to register with the county sheriff at the following times, after being released from prison or placed on parole (Sec. 3):
    • Annually for 10 years, for a level 1 offender;
    • Annually for 20 years, for a level 2 offender;
    • Annually for 30 years, for a level 3 offender;
    • Semi-annually for 40 years, for a level 4 offender; and
    • Quarterly for life, for a level 5 offender.
  • Increases the registration fee for an offender from $50 to $80 (Sec. 3).
  • Authorizes an offender other than a level 5 offender to petition the district court for exemption from registering as an offender if certain requirements are met, including, but not limited to, the following requirements (Sec. 5):
    • The offender has completed half of his or her full registration term;
    • The offender demonstrates that he or she has maintained continuous time in the community; and
    • The offender provides a current psychosexual evaluation by a certified evaluator.
  • Specifies that a level 5 offender may be monitored with electronic monitoring technology for the duration of his or her probation or parole, whereas existing law requires an individual designated as a “violent sexual predator” to be monitored (Sec. 4).
