Title: Requires Maternity Health Plans to Cover Abortion

Highlights:

  • Requires a health plan issued or renewed on or after January 1, 2016, that provides coverage for maternity care or services, to provide coverage for legal voluntary termination of a pregnancy (Sec. 3).
  • Exempts a plan from the abortion coverage requirement to the minimum extent necessary for the state to be in compliance with federal requirements that determine the allocation of federal funds to the state (Sec. 3).
  • Requires a health plan issued or renewed on or after January 1, 2016 to cover certain expenses, including, but not limited to, the following expenses (Sec. 2):
    • A contraceptive drug, device, or other product approved by the federal Food and Drug Administration;
    • A sterilization procedure; and
    • A consultation, examination, procedure, or medical service that is necessary to prescribe, dispense, insert, deliver, or remove the drugs, devices and other products.
  • Requires a health plan issued or renewed on or after January 1, 2016 to provide reimbursement to the provider or dispensing entity for up to a 12-month supply of contraceptives obtained at one time by an enrollee (Sec. 2).
  • Prohibits a health carrier from denying coverage to an enrollee if the enrollee has changed his or her birth control within a 12 month period (Sec. 2).
  • Requires coverage under the provisions of this bill to include an enrollee, an enrolled spouse, and enrolled dependents, regardless of race, color, national origin, sex, sexual orientation, gender expression, marital status, age, or disability (Sec. 2).
