Title: Prohibits Texting While Driving

Vote to pass a bill that prohibits texting while driving.

Highlights:

  • Prohibits an individual from using a “wireless communication device” to manually write, send, or read a written message while operating a motor vehicle, including when the vehicle is not in motion due to traffic, a traffic light, or a stop sign (Sec. 2).
  • Defines “wireless communication device” as a wireless telephone, text-messaging device, or any other similar communication device that is readily removable from the vehicle and is used to write, send, or read text or data through manual input (Sec. 2).
  • Exempts the following individuals from the provisions of this bill (Sec 2.):
    • An individual who has driven to a location where she or he can safely stop prior to using a wireless communication device;
    • An individual using a wireless communication device to contact emergency services; or
    • An individual who is an operator of an emergency vehicle, a commercial motor vehicle, or a school bus and is using equipment in the performance of her or his duties.
  • Prohibits recording a violation of this bill on an individual’s driving record or assessing points on her or his record because of the violation (Sec. 2).
  • Establishes the following fines for violations of this bill (Sec. 2):
    • $50 for a first violation;
    • $100 for a second violation; and
    • $200 for a third and any subsequent violations.
  • Requires an individual operating a motor vehicle who commits a moving violation while texting to be fined $100 in addition to the fine imposed for the moving violation (Sec. 2).
