Vote to adopt a conference report that increases regulations on day care providers.

Highlights:
  • Requires an individual seeking paid employment, applying to volunteer in, or applying for licensure of a child day program to undergo a background check, effective July 1, 2017 (Sec. 1).
  • Specifies that a background check must consist of the following requirements (Sec. 1):
    • The individual must submit to fingerprinting and provide personal descriptive information; 
    • The individual must provide a sworn statement or affirmation disclosing any convictions or pending criminal charges, and whether the individual has been subject to any founded complaint of child abuse or neglect; and 
    • The individual must authorize the employer or the Department of Social Services to obtain a copy of any information in the state’s central registry relating to child abuse or neglect.
  • Prohibits a child day program from hiring a paid or volunteering individual found to have been convicted of a felony (Sec. 1).
  • Requires family day homes, which provide compensated child care in an individual’s home, serving 5 through 12 children to be licensed, effective July 1, 2016 (Sec. 1). 
  • Requires every unlicensed, unregistered family day home to provide written notice to the parents of any child under their care stating that they are not regulated by the department and to refer them to a website maintained by the department that provides information on licensed, registered and unlicensed, unregistered family day homes (Sec. 1).
  • Requires the department to develop “appropriate” criminal and civil penalties for those who operate or engage in the conduct of a child day program without the proper licensing as required by the provisions of this bill (Sec. 1).
  • Requires a child day program that is funded in whole or in part by the Child Care and Development Block Grant to comply with federal law and regulations (Sec. 1).
