Vote to pass a bill that amends provisions relating to constructional defect dispute resolutions.

Highlights:
  • Defines a “construction defect” as having the following qualities (Sec. 6):
    • The defect presents an unreasonable risk of injury to a person or property; or
    • The defect is not completed in a “good and workmanlike” manner and causes physical damage to the residence.
  • Prohibits an owner from taking legal action for a construction defect 6 years after the completion of his or her residence (Sec. 17).
  • Prohibits an individual filing a legal claim due to a construction defect from recovering “reasonable” attorney’s fees (Sec. 15).
  • Requires an individual to first submit a claim under the homeowner’s warranty for a construction defect and have that claim denied before the individual can take further legal action (Sec. 14).
  • Requires a claimant to identify in specific detail each defect, damage, and injury to each residence, including the exact location of each defect, damage, and injury (Sec. 8).
