Title: Prohibits Government from Burdening an Individual's Exercise of Religion

Vote to pass a bill that prohibits the government from any action that would interfere with an individual's exercise of religion.

Highlights:

  • Prohibits the government from “substantially burdening” an individual’s “exercise of religion” except when the following criteria are met (Secs. 2 & 5):
    • The government does so to further a governmental interest; and
    • The government uses the least restrictive means available to further that interest.
  • Defines “exercise of religion” as the practice or observance of religion, including an act or refusal to act that is motivated by a sincerely held religious belief (Sec. 4).
  • Authorizes an individual to assert a claim or defense when an unauthorized government action burdens the religious practices of the individual (Sec. 5). 
  • Specifies that if any provision or application of this act is considered unconstitutional, the remainder of the act will not be affected and may still be applied to any other individual or circumstance (Sec. 7).
