Title: Expands Jailhouse Strip Search Requirements

Vote to pass a bill that expands the requirements necessary to conduct a strip search on certain detained individuals.

Highlights:

  • Expands the requirements needed to conduct a jailhouse strip search on a detained individual, to include the following criteria (Secs. 1 & 2): 
    • The detained individual has been arrested for any felony or certain misdemeanors;
    • The detained individual has been arrested or otherwise lawfully detained by law enforcement; or
    • The detained individual will be incarcerated, imprisoned, or otherwise detained in a jail or prison with one or more individuals for not less than 12 hours. 
  • Specifies that in order for a law enforcement official to conduct a strip search on a detained individual certain criteria including, but not limited to, the following criteria must apply (Secs. 3, 4, & 6):  
    • The law enforcement official conducting the search is the same sex as the detainee, unless the search is a body cavity search conducted by a physician, physician assistant, or registered nurse; 
    • The detained individual is not exposed to the view of any individual not conducting the search; and
    • The strip search is not reproduced through a visual or sound recording.
