Title: Minimum Wage Fairness Act

Vote on a motion to invoke cloture on the motion to proceed to debate on a bill that increases the federal minimum wage to $10.10 an hour.

Highlights:

  • Increases the federal minimum wage from $7.25 an hour to an amount as follows (Sec. 2):
    • $8.20 an hour, beginning 6 months after the enactment of this bill;
    • $9.15 an hour, beginning 1 year after the first raise; 
    • $10.10 an hour, beginning 2 years after the first raise; and
    • An amount determined annually by the Secretary of Labor based on certain criteria, beginning 3 years after the first raise. 
  • Requires the Secretary of Labor to determine, no later than 90 days prior to the date on which a new minimum wage is to take effect, that the pursuant wage for the subsequent year follows criteria including (Sec. 2):
    • The wage is not less than the amount currently in effect;
    • The wage is rounded to the nearest multiple of $0.05; and
    • The wage is increased from such an amount by the annual percentage increase in the Consumer Price Index for Urban Wage Earners and Clerical Workers.
  • Increases the federal minimum wage for “tipped employees” to $3.00 an hour for a 1-year period beginning 6 months after the enactment of this bill and increases the wage each successive year until the wage is equal to 70 percent of the current federal minimum wage of all other employees by the lesser of the following (Sec. 2):
    • $0.95 an hour; or
    • An amount necessary for the wage to equal 70 percent of the current federal minimum wage, rounded to the nearest $0.05.

NOTE: THIS IS A VOTE TO INVOKE CLOTURE ON A MOTION TO PROCEED, WHICH SENDS THE LEGISLATION TO THE FLOOR OF THE SENATE FOR DEBATE AND AMENDMENT. A MOTION TO PROCEED ALONE REQUIRES A MAJORITY FOR APPROVAL. HOWEVER, THE MOTION CAN BE FILIBUSTERED, AND WHEN THIS OCCURS, A CLOTURE VOTE IS NECESSARY TO VOTE ON THE MOTION TO PROCEED. A THREE-FIFTHS MAJORITY OF THE SENATE IS NECESSARY TO INVOKE CLOTURE.
