Vote to pass a bill that requires an individual to register with the state to be a health care insurance navigator.

Highlights:
  • Prohibits an individual from performing, offering to perform, or advertising any service as a “health care insurance navigator” after June 30, 2015 without first registering with the attorney general (Secs. 3 & 4).
  • Defines “health care insurance navigator” as an individual who performs or assists with certain duties, including, but not limited to, the following duties (Secs. 2 & 3):
    • The individual facilitates enrollment in “qualified health plans;”
    • The individual conducts public education activities that raise awareness of the availability of “qualified health plans;” and
    • The individual distributes fair and impartial information concerning enrollment in “qualified health plans.”
  • Requires an individual applying for registration as a health care insurance navigator to provide certain items, including, but not limited to, the following items (Sec. 3):
    • A set of fingerprints;
    • A $100 non-refundable application renewal or registration fee; and
    • A record of the applicant’s credit rating and bankruptcies, if any.
  • Authorizes the attorney general to require an applicant for registration as a health care insurance navigator to submit to a state and national criminal history record check (Sec. 5).
  • Prohibits a health care insurance navigator from performing certain actions, including, but not limited to, offering advice about which health insurance plan is better or worse for a particular individual or employer (Sec. 3).
  • Authorizes an individual to file a “duly verified” complaint with the attorney general alleging that a health care insurance navigator is violating the provisions of this bill (Sec. 6).
  • Authorizes the attorney general to investigate a complaint against a health care insurance navigator and charge the health care provider with “reasonable costs” from the investigation (Sec. 6).
  • Classifies a violation of this bill as a civil penalty with a fine of at least $100, but no more than $3,000, for each violation (Sec. 7).
  • Requires the attorney general to maintain a public website with a complete list of all currently registered health care insurance navigators (Sec. 3).
