Vote to pass a bill that classifies personal possession of marijuana as a civil violation, effective January 1, 2015.

Highlights:
  • Classifies the possession of the following substances as a civil violation with a maximum fine of $100 if the individual is 18 years of age or older (Sec. 1):
    • 1 ounce or less of marijuana; or
    • 5 grams or less of hashish.
  • Requires an individual under the age of 18 in possession of less than 1 ounce of marijuana or less than 5 grams of hashish to complete the following actions (Sec. 1):
    • Forfeit the marijuana or hashish;
    • Complete an alcohol and substance abuse education program; 
    • Participate in community service; and
    • Have a parent notified of the possession.
  • Requires an individual under the age of 18 to pay a $750 fine if he or she does not complete an alcohol and substance abuse education program and community service (Sec. 1).
  • Classifies the possession, propagation, cultivation, growth, harvest, or manufacture of 6 or fewer marijuana plants as a Class A misdemeanor (Sec. 2).
