Vote to pass a bill that prohibits smoking in certain public places.

Highlights:

• Prohibits smoking in an enclosed public place and an enclosed place of employment (Sec. 4).

• Prohibits smoking in outdoor areas including, but not limited to, the following areas (Sec. 5):
• Within 15 feet of an entrance, exit, window, or ventilation intake that serves an enclosed area;
• Within 15 feet of outdoor seating and serving areas of a restaurant or bar;
• Within 15 feet of bleachers and grandstands used for spectators at a public event; and
• Within 15 feet of, and in, an outdoor playground.

• Exempts certain areas from the provisions of this bill including, but not limited to, the following areas (Sec. 6). 
• A bar;
• A private club existing and operating on the effective date of this bill; 
• A retail tobacco shop or venue; and 
• A private residence, unless the private residence is licensed as a child care, adult care, or health care facility.

• Specifies that an individual smoking in a prohibited area violates the provisions of bill and will be fined up to $50 (Sec. 10).

• Specifies that an individual who owns, manages, or operates an enclosed public place or place of employment and who violates the provisions of this bill will be fined accordingly (Sec. 10):
• A criminal fine no more than $100 for the first violation;
• A criminal fine of no more than $200 on the second violation and subsequent violations that occur within 1 year of the previous violation; and
• A civil fine no more than $1000 in addition to applicable criminal fines upon the third violation and subsequent violations that occur within 1 year of the previous violation. 

• Specifies that the bill takes effect on the first day of the third month after the bill is approved by the governor (Sec. 18).
