Vote to concur with House amendments and pass a bill that authorizes same-sex marriage, effective December 2, 2013.
- Amends Hawaii state law to refer to a valid marriage contract as between two individuals without regard to gender (Sec. 3).
- Requires any state law that refers to, adopts, or relies upon federal law to apply to all marriages recognized under the laws of this state (Sec. 2).
- Specifies that any marriage between two individuals that is legal where the marriage was performed is to be considered legal in Hawaii (Sec. 4).
- Specifies that all gender-specific terminology is to be understood in a gender-neutral manner when necessary to implement rights, benefits, protections, and responsibilities of spouses under all sources of Hawaii state law, including administrative rules, court decisions, common law, or any other sources of law (Sec. 2).
- Prohibits any officer of a religious denomination that provides solemnization of marriage or civil union from being required to solemnize any marriage or civil union that is in violation of religious beliefs or faith (Sec. 2).
- Exempts an officer of a religious denomination from any fine, penalty, injunction, administrative proceeding, or other legal or administrative liability for a refusal to provide services under this bill (Sec. 2).
- Prohibits a religious organization or nonprofit organization that is operated or controlled by a religious organization from being required to provide goods, services, or its facilities or grounds for solemnization or celebration of a marriage or civil union that is in violation of its religious beliefs or faith (Sec. 2).
- Exempts a religious organization or nonprofit organization that is operated or controlled by a religious organization from any fine, penalty, injunction, administrative proceeding, or other legal or administrative liability for the failure or refusal (Sec. 2).
