Vote to concur with Senate amendments and pass a bill that authorizes retail medical marijuana establishments.

Highlights:

  • Authorizes the transfer of usable and immature marijuana plants at medical marijuana facilities registered through the Oregon Health Authority between the following entities (Sec. 2):
    • A medical marijuana facility to a registry identification cardholder or caregiver of a cardholder; or
    • A registry identification cardholder, caregiver of a cardholder, or an individual responsible for a marijuana grow site to the medical marijuana facility.
  • Requires medical marijuana facilities to meet certain requirements in order to qualify for registration including, but not limited to, the following (Sec. 2):
    • The facility must not be located within 1,000 feet of a public or private elementary, secondary or career school attended primarily by minors;
    • The facility must not be located within 1,000 feet of another medical marijuana facility; and
    • The facility must not be located at the same address as a marijuana grow site.
  • Requires a medical marijuana facility to renew its registration annually (Sec. 2).
  • Prohibits individuals convicted for the manufacture or delivery of a controlled substance from being responsible for a medical marijuana facility within the first 5 years following the date of conviction (Sec. 2).
  • Prohibits individuals convicted for the manufacture or delivery of a controlled substance more than once from being responsible for a medical marijuana facility (Sec. 2).
  • Requires individuals responsible for medical marijuana facilities to display proof of registration on the facility premises at all times usable marijuana or immature marijuana plants are being transferred (Sec. 2).
  • Authorizes the Oregon Health Authority to inspect a registered medical marijuana facility to determine whether the facility is in compliance with the provisions of this bill (Sec. 7).
  • Exempts individuals responsible for or employed by a medical marijuana facility from the criminal laws of the state for possession, delivery or production of marijuana if the individual does not commit these acts anywhere other than at the medical marijuana facility (Sec. 5).
