Highlights:
Prohibits an employer from requiring or requesting an employee or job applicant to disclose any username, password, or any other means for accessing a personal e-mail account or social networking profile through an “electronic communication device,” except in the following circumstances (Sec. 1):
The employer and the employee have entered into a contractual agreement under which the employee consents to the disclosure of any means for accessing a personal e-mail account or social networking profile;
The employer is a state or local law enforcement agency; or
The social media account belongs to a financial services employee who uses the account to conduct the business of his or her employer.
Defines “electronic communication device” as a computer, telephone, personal digital assistant, or similar device that uses electronic signals to create, transmit, and receive information (Sec. 1).
