Title: Establishes an Additional Sales Tax for Local Transportation Projects

Vote to pass a joint resolution that establishes an additional 1 percent sales tax for local transportation projects.

Highlights:

  • Establishes an additional state sales tax of 1 percent to be applied to the following taxes (Sec. A):
    • A tax on the selling and leasing tangible personal property or rendering taxable services at retail, except for food as defined under the Sales Tax Law;
    • A tax on the storing, usage or consumption of tangible personal property; or
    • A tax on all new or used motor vehicles, trailers, motorcycles, mopeds, motor tricycles, boats and outboard motors that are purchased or acquired for use on the highways and waterways.
  • Prohibits state revenues derived from highway users which are imposed, collected, or  apportioned in the state road fund from being diverted from “highway purposes” (Sec. A).
  • Appropriates proceeds from the additional state sales and use taxes according to the following schedule (Sec. A):
    • 5 percent of proceeds to the County Aid Transportation Fund;
    • 5 percent of proceeds to the Municipal Aid Transportation Fund; and
    • 90 percent of proceeds to the Transportation Sales Tax Fund.
  • Prohibits the general assembly, counties and municipalities from increasing or reducing the   additional sales tax, unless approved by the voters (Sec. A). 
  • Requires the highways and transportation commission to approve a list of projects, programs and facilities on the state highway and state transportation systems that will be funded from the proceeds from the additional sales and use taxes (Sec. A). 
  • Prohibits the state highways and transportation commission from operating a toll highway or toll bridge on a state highway or bridge that is in existence as of January 1, 2015, while the authorized sales and use tax is in effect (Sec. A). 
  • Requires the additional 1 percent state sales and use tax to be effective and continue until a general election is held in 2024, or until a special election called by the governor occurs (Sec. A).

NOTE: AN AMENDMENT TO THE CONSTITUTION REQUIRES APPROVAL BY A SIMPLE MAJORITY IN THE HOUSE AND THE SENATE, AND THEN APPROVAL BY A SIMPLE MAJORITY OF VOTERS DURING AN ELECTION.
