Vote to pass a bill that prohibits texting while operating a motor vehicle, effective September 1, 2013.

Highlights:

• Prohibits an individual from using a handheld wireless communication device to read, write, or send a written message while operating a motor vehicle except in the following circumstances (Sec. 5):
• The device is used in conjunction with voice-operated technology, a push-to-talk function, or a hands-free device;
• The device is used while the motor vehicle is stopped;
• The device is used to read or input a telephone number for the purpose of making a call;
• The device is used to navigate a global positioning system; 
• The device is used to contact emergency help; or
• The individual reasonably believes the text-based communication concerns an emergency.

• Prohibits a peace officer who stops a driver for an alleged violation of the provision from taking possession of or inspecting a wireless communication device without the consent of the driver (Sec. 5).

• Classifies a violation of this bill as a misdemeanor, and establishes the following penalties for violations of this bill (Sec. 2):
• For the first offense, a fine of no more than $100; and
• For the second offense, a fine of no more than $200.

• Rep. Jonathan Strickland is not listed in our vote breakdown because he was excused due to family matters; he would have voted “Nay.”
