Highlights:

  • Requires a physician to request written informed consent from a parent or guardian of the minor before performing an abortion unless the minor (Secs. 2, & 6-8):
    • Is emancipated;
    • Is granted court approval by a judge who deems her to be mature and capable of giving informed consent;
    • Declares that she was the victim of sexual or physical abuse by her parent or guardian; or
    • Experiences a life threatening medical emergency as determined by the physician.
  • Requires a physician to wait 48 hours after the request for written informed consent has been delivered to the parent before performing an abortion on a minor (Sec. 2).
  • Repeals the “judicial waiver” provision which authorizes a judge to give consent on behalf of a pregnant minor (Sec. 2).
