Vote to pass a bill that requires buy-here-pay-here car sellers to provide a limited warranty.

Highlights:

• Requires buy-here-pay-here dealers to issue a warranty for used vehicles leased or sold at retail price that includes at minimum the following coverage, whichever occurs first (Sec. 2):
• Warranty coverage for 30 days from the date of the contract; or
• Warranty coverage for 1,000 miles.

• Prohibits a buy-here-pay-here dealer from tracking a vehicle it sold with electronic tracking technology without the buyer’s written consent and classifies a violation as a misdemeanor with a fine of up to $1,000 (Sec. 4).

• Prohibits a buy-here-pay-here dealer from disabling a vehicle it sold using ignition override technology unless the dealer meets the following requirements and classifies a violation as a misdemeanor with a fine of up to $1,000 (Sec. 4):
• Notifies the buyer in writing at the time of the sale that the vehicle is equipped with ignition override technology; and
• Uses ignition override technology that informs the driver at least 120 hours in advance and every time the vehicle is started that the vehicle will be made inoperable in no less than 120 hours.

• Prohibits a buy-here-pay-here dealer from requiring buyers to make payments, other than the down payment, to the seller in person and classifies a violation as a misdemeanor with a fine of up to $1,000 (Sec. 4).
