Title: Prohibits Open Carry of Certain Unloaded Firearms

Vote to pass a bill that prohibits open carry of certain unloaded firearms.

Highlights:

  • Prohibits an individual from openly carrying an unloaded firearm that is not a handgun in an incorporated city, whereas existing law prohibits openly carrying an unloaded handgun in unincorporated areas (Sec. 12).
  • Classifies the open carry of an unloaded firearm that is not a handgun in an incorporated city as a misdemeanor punishable by the following (Sec. 12):
    • No more than 1 year in county jail;
    • A fine of up to $1,000; or
    • Both a fine and imprisonment if the firearm and ammunition are in the individual's immediate possession.
  • Exempts individuals from the provisions of this bill in certain situations including, but not limited to, the following (Sec. 12):
    • The individual holding an unloaded firearm is within a place of business, a place of residence, or on private property where the owner of the property allows that individual to carry a firearm;
    • The firearm is either in a locked container or case and is being transported directly between places where individuals are not prohibited from possessing firearms;
    • The individual holding an unloaded firearm is a peace officer or an honorably retired peace officer who is authorized to carry such a weapon; or
    • The individual holding an unloaded firearm is a licensed hunter who is engaged in hunting or going to or returning from that hunting expedition.
