Vote to pass a bill that prohibits in-state tuition for undocumented immigrants.

Highlights:

• Requires students who receive “standard-rate tuition” to meet the following requirements (Sec. 1):
• Attendance at a public or private high school in Colorado for 3 or more years immediately preceding the date the student graduated from a Colorado high school or earned a GED certificate in Colorado; and 
• Admission to an institution of higher education in Colorado within 12 months after graduating from high school or earning a GED certificate.

• Defines “standard-rate tuition” as equivalent to the student’s share of in-state tuition plus an amount equal to the college opportunity fund stipend for in-state students (Sec. 1).

• Requires students applying for the standard-rate tuition classification who do not have documentation of lawful immigration or nationality status to submit an affidavit to the institution to which they have been admitted stating that the student has requested documentation of, has applied for, or will be applying for, lawful status as soon as the student is eligible (Sec. 1).

• Prohibits students who are classified as a standard-rate tuition student from receiving a college opportunity fund stipend or any state-funded, need-based financial aid (Sec. 1).

• Specifies that students who qualify for standard-rate tuition are not considered residents of Colorado and cannot use this classification to establish residency (Sec. 1).

• Requires institutions who offer standard-rate tuition to annually report to the Department of Higher Education the “student number” for each student who receives standard-rate tuition, as well as whether or not the student has submitted an affidavit stating that he or she will apply for lawful immigration status (Sec. 1).
