Title: Prohibits Minors from Using Tanning Beds

Vote to pass a bill that restricts the use of tanning beds for minors.

  • Prohibits the use of tanning beds by individuals 15 years of age or younger, unless the use is authorized by a prescription from a licensed medical provider (Sec. 1).
  • Prohibits the use of a tanning bed by those persons between the ages of 16 to 18 years old, unless either of the following conditions are met (Sec. 1):
    • The use is authorized by a prescription from a licensed medical provider; or
    • The parent or legal guardian provides in-person consent by signing a written consent form in the presence of an employee or the owner of the tanning facility on the first visit.
  • Requires written consent forms to include the phrases, “DANGER – ULTRAVIOLET RADITION FROM TANNING DEVICES IS KNOWN TO CAUSE CANCER IN HUMANS” and “Exposure to ultraviolet radiation may cause skin cancer, including potentially fatal melanoma, as well as serious eye and skin injury including, but not limited to, wrinkling, dryness, fragility, and bruising of skin” (Sec. 1).
  • Limits the use of tanning beds by individuals under the age of 18 who have received parental or guardian consent or who have a prescription to no more than 3 times in 1 week and no more than 1 time in 24 hours (Sec. 1).
  • Authorizes the owners and employees of a tanning facility to verify the age of any person under the age of 18 using valid government identification or documents that include the date of birth of the individual (Sec. 1).
  • Prohibits owners or employees of tanning facilities from verbally claiming, advertising, or distributing promotional materials that claim that a tanning device is safe or risk-free (Sec. 1).
  • Requires a tanning facility with more than 1 patron under the age of 18 to display a sign, readily visible upon entry and within 3 feet of each tanning device, which warns of the dangers of using a tanning device (Sec. 1).
