Title: Amends Three Strikes Law

Vote to pass a bill that amends the "Three Strikes" law by requiring the third conviction to be a serious or violent felony in order for a defendant to receive an enhanced sentence.

Highlights:

  • Limits the application of an enhanced sentence to cases in which (Secs. 1 & 3):
    • A defendant, who has 2 or more prior serious or violent felony convictions, has a third conviction for a serious or violent felony;
    • The third felony conviction is a serious or violent crime, including, but not limited to:
      • Certain controlled substance offenses;
      • Felony sex offenses;
      • The defendant used or was armed with a deadly weapon or firearm; or
      • The defendant intended to cause great bodily harm; or
    • The defendant was previously convicted for:
      • A sexually violent offense;
      • A sex crime against a child; or
      • Any other serious or violent felony punishable by life imprisonment or death.
  • Effective upon approval of California voters in the November 4, 2014 statewide general elections (Sec. 7).
