Title: Labor Law Amendments

Vote to pass a bill that limits the authority of the National Labor Relations Board with regard to petitions for union representation and union elections, and restricts the number and composition of collective bargaining units.

Highlights:

  • Prohibits the National Labor Relations Board from considering a petition for union representation less than 14 days after the petition is filed (Sec. 2).
  • Prohibits the National Labor Relations Board from conducting a union election less than 35 days after the election petition is filed (Sec. 2).
  • Limits the composition of a collective bargaining unit to employees who share a "sufficient community of interest" (Sec. 2).
  • Requires the National Labor Relations Board to consider certain criteria when determining whether a proposed collective bargaining unit contains employees who share a "sufficient community of interest" including, but not limited to, the following (Sec. 2):
    • Similarity of wages, benefits and working conditions;
    • Similarity of skills and training;
    • Similarity of job functions and work; and
    • Frequency of contact between employees.
  • Prohibits the National Labor Relations Board from excluding employees from a bargaining unit unless the interests of the excluded group are "sufficiently distinct" from those of other employees in the unit (Sec. 2).
