Title: Authorizing Speed Cameras in Certain Cities

Vote to pass a bill that allows government agencies to establish automated speed enforcement systems, effective July 1, 2012.

Highlights:
  • Defines "automated speed enforcement system" as a device installed in a safety zone for the purpose of capturing a picture of a vehicle and its registration plate while a driver is violating traffic laws (Sec. 11-208.8).
  • Defines "safety zone" as an area within one-eighth of a mile of the property line of schools and public parks (Sec. 11-208.8).
  • Specifies that an owner of a vehicle that is recorded to have a violation by an automated speed enforcement system is subject to a civil penalty not exceeding $100 for each violation, plus an additional penalty of not more than $100 for failure to pay the original penalty in a timely manner (Sec. 11-208.8).
  • Specifies that the net proceeds that a municipality receives from civil penalties imposed under an automated speed enforcement system shall be issued for the following purposes (Sec. 11-208.8):
    • Public safety initiatives;
    • Initiatives to improve pedestrian and traffic safety; and
    • Construction and maintenance of infrastructure within the municipality.
  • Authorizes a technician employed by a municipality to determine whether a vehicle is in violation of the law in the case of an automated speed enforcement system violation (Sec. 11-208.3).
  • Requires that a municipality using an automated speed enforcement system provide notice to drivers by publishing the locations of all safety zones that contain system equipment (Sec. 11-208.8).
