  • Specifies that the spouse of the pregnant women, or either parent of the woman if the woman is under the age of 18, at the time of the partial birth/late-term abortion may file a civil action against the physician or individual and may recover the following (Sec. 4):
    • Actual damages including damages for emotional distress and;
    • Treble damages for the cost of the partial birth/late-term abortion.
