Title: Background Checks for Contractors on School Premises

Vote to pass a bill that requires all contractors and their employees on public school premises where children are present to submit to a criminal history background and child protection registry check.

Highlights:

  • Prohibits access to school premises with children present for those who have been convicted of certain felonies, is currently on the Child Protection Registry, or has ever been convicted of offenses in which the victim was a child (Sec. 1).
  • Requires all contractors, subcontractors and employees who have not undergone the required checks to be accompanied by an agent of the public at all times while on the premises (Sec. 1).
  • Authorizes the public school to permit persons without the required checks to access the premises only in the event of a disaster or emergency (Sec. 1).
  • Requires that the contractor or subcontractor must pay for any necessary check (Sec. 1). 
  • Requires criminal history background check to be no more than two years old (Sec.1).
  • Specifies this act will become effective January 30, 2012 (Sec. 2).

NOTE: ACCORDING TO THE STATE CONSTITUTION, A BILL MUST RECEIVE THE VOTES OF A MAJORITY OF THE MEMBERS ELECTED TO EACH CHAMBER IN ORDER TO BECOME LAW. THEREFORE, A BILL MAY RECEIVE MORE 'YEAS' THAN 'NAYS' AND STILL FAIL BECAUSE IT DID NOT RECEIVE 'YEA' VOTES FROM A MAJORITY OF THE MEMBERS OF THAT CHAMBER.
