Title: Prohibits Distracted Driving

Vote to pass a bill that prohibits individuals from driving on a highway in a careless, imprudent, or inattentive manner.

Highlights:

  • Increases the fee for violations of the ordinance about care required in operating a vehicle to not less than $30 and no more than $50 (Sec. 1).
  • Establishes that an individual may not operate a vehicle on a highway in the following, but not limited to, conditions (Sec. 2):
    • In a careless manner;
    • In an imprudent manner;
    • In an inattentive manner;
    • Driving in a manner that creates a hazard to the life, limb, or property of any person;
    • Driving without having due regard to the existing conditions, including the traffic, surface, and width of the highway; or
    • Driving without giving warnings as are reasonably necessary for safe operation under the circumstances.

  • Prohibits an operator of a motor vehicle from engaging in an activity that requires the use of the operator's sight while the vehicle is in motion or a part of traffic, a violation of which is subject to a fine of $100 (Sec. 3).
  • Authorizes drivers to use any of the following (Sec. 3):
    • An electronic device that does not require "direct initiation" by the driver;
    • A voice-operated device;
    • A navigational system; or
    • An electronic device to obtain emergency assistance, report a crime, or report a traffic offense, hazard, or accident.
  • Prohibits a law enforcement officer from issuing a citation for a violation of this bill unless the officer initially stopped the operator of the vehicle for a different violation (Sec. 3).

THEREFORE, A BILL MAY RECEIVE MORE 'YEAS' THAN 'NAYS' AND STILL FAIL BECAUSE IT DID NOT RECEIVE 'YEA' VOTES FROM A MAJORITY OF THE MEMBERS OF THAT CHAMBER.
