Title: Ban on Smoking in Public Places

Vote to pass a bill that bans smoking in certain public areas.

Highlights:

  • Prohibits smoking in the following locations (Sec. 1):
    • Enclosed areas in which the public is permitted;
    • Enclosed areas of places of employment;
    • Vehicles owned, leased, or operated by the state that are being used for governmental functions; and
    • Within 12 feet of public entrances to the above enclosed areas.
  • Authorizes smoking in the following locations (Sec. 1):
    • Horse racing facilities;
    • Riverboats;
    • Facilities that operate under gambling game licenses;
    • Satellite facilities;
    • Retail tobacco stores used primarily for the sale of tobacco products;
    • Bars or taverns that hold permits to sell alcohol and do not allow underage individuals to enter areas where smoking is permitted;
    • Clubs that are exempt from federal income taxes and provide designated smoking areas where underage individuals are not permitted; and
    • Health facilities that provide designated smoking areas where underage individuals are not permitted.
  • Defines "smoking" as carrying or holding, or inhaling or exhaling from, a lit smoking device, including, but not limited to, a cigarette, cigar, or pipe (Sec. 1).
  • Authorizes local governments to adopt more restrictive smoking regulations (Sec. 1).
