Title: Labor Law Amendments

Vote to pass a bill that amends Illinois labor law relating to public employees.

Highlights:

  • Specifies that policy-making employees, as well as other employees excluded from the definition of "public employee", are not protected with regard to the following (Sec. 6):
    • Organizing, assisting or joining a labor organization;
    • The exercise of collective bargaining through representatives of their own choosing; and
    • Any other activities pursuant to collective bargaining.
  • Defines a "policy-making employee" as any employee of offices under the jurisdiction of the Governor, Attorney General, Secretary of State, Comptroller, or Treasurer who meets criteria including, but not limited to, any of the following (Sec. 3):
    • An employee whose functions include the determination of policy or responsibility for the way in which policy is carried out;
    • An employee who advises a State agency head or an executive branch constitutional officer regarding legal matters;
    • An employee who engages in crafting legislation, lobbying, or contacting General Assembly members on behalf of a State agency or an executive branch constitutional officer to influence the outcome of legislation before the General Assembly; or
    • An employee whose position authorizes, either directly or indirectly, meaningful input into government decision-making on issues such as goals and implementation.
  • Excludes from the definition of "public employee" certain types of employees including, but not limited to, the following (Sec. 3):
    • Employees in the Office of the Governor, the Governor's Office of Management and Budget, or the Office of the Lieutenant Governor;
    • Legislative liaisons;
    • Senior Public Service Administrators;
    • State employees in the Office of the Attorney General who are licensed to practice law;
    • State employees in the Office of the Comptroller who are Public Service Administrators, or who hold positions that are exempt under the Comptroller Merit Employment Code;
    • State employees under the jurisdiction of the Secretary of State whose positions are classified as Executive I or higher, or who are exempt from the Secretary of State Merit Employment Code;
    • State employees under the jurisdiction of the Treasurer who are exempt from the State Treasurer Employment Code; and
    • Policy-making employees.
  • Defines a "legislative liaison" as an employee of any office under the jurisdiction of the Governor, Lieutenant Governor, Attorney General, Secretary of State, Comptroller, or Treasurer who, in the course of his or her employment, communicates with any state legislative official or legislative staff member for the purpose of influencing legislative action (Sec. 3).
