Vote to pass a bill that exempts from federal regulation certain firearms and firearm accessories that are manufactured and retained in South Dakota, beginning July 1, 2010.

Highlights:

• Specifies that any firearm, firearm accessory, or ammunition that is manufactured and retained within South Dakota has not been subject to interstate commerce, and is therefore exempt from federal regulation (Sec. 2).

• Specifies that the following remain subject to federal regulation (Sec. 3):
• Any firearm that cannot be carried and used by a single person;
• Any firearm that has a bore with a diameter greater than 1.5 inches and that uses smokeless powder, rather than black powder;
• Any firearm that discharges more than a single projectile per firing; and
• Ammunition with a projectile that explodes after leaving the firearm.

• Requires all firearms that are manufactured in South Dakota and that are exempt from federal regulation to be clearly stamped with the words "Made in South Dakota" on a central metallic part of the firearm (Sec. 4).
