Title: Home Solicitation Regulations

Vote to concur with Senate amendments and pass a bill that would require door-to-door solicitors to obtain and display a state-issued identification badge and operate within a newly specified time frame beginning 120 days after the date of enactment, or be charged a fine.

Highlights:

-Requires any seller or representative of a seller who solicits door-to-door sales to wear an identification badge, issued by the Department of Finance, that contains the following information (Sec. 2):

    -Seller's business name; -Full legal name of seller of seller's representative; -Telephone number of seller; -Address of seller's place of business; and -State of Delaware business license number of seller.
-Establishes legal hours for door to door solicitation to be between 9 a.m. and 8 p.m. (Sec. 2). -Establishes a first offense penalty for not displaying a state issued identification badge, or soliciting outside of the specified hours of not less than $75 but not more than $150, and a penalty for each subsequent offense of not less than $100 but not more than $250 (Sec. 2). -Exempts from the penalty sales solicited in the following manner (Sec. 2):
    -Via telephone, mail, email, or Internet; -When the seller or seller's representative has been solicited by the resident for the sale; -When the resident invites the seller or seller's representative into and/or to the home; -By a non-profit organization; -By a public utility or cable television system operator, provided that the operator displays an identification card containing the name of the public utility or cable television company; or -By a person selling educational materials affiliated with an accredited university.
-Exempts from the penalty salespeople who leave written solicitations or advertising materials at a person's residence without speaking to that person (Sec. 2).
