Vote to concur with House amendments and pass a bill that requires the Governor to establish a process that is operable by July 1, 2010 to allow citizens to lodge concerns relating to state or local government entities "unfairly competing" with the private sector in providing commercial activities.

Highlights:

-Requires the process, at minimum, to include a link entitled "government competition concerns" on the main page of the official state website and a means for citizens to access summary data and lodge a concern with governmental competition, including (Sec. 1):

    -The entity involved; -The activity involved; -Whether the concern is a result of a specific instance or ongoing activity; -The effect of the competition on the citizen's commercial activity; and -A means to contact the citizen for further information.
-Requires the Governor to report the following information to the Legislature beginning July 1, 2010 (Sec. 1):
    -The number of concerns related to "unfair competition" received; -The number of concerns lodged and the number of citizens lodging concerns for each government entity; -A summary of whether the program, function, or activity that is the subject of a complaint was identified in the entity's strategic plan as one which could be implemented more effectively by another level or government or private entity; and -Any recommended legislation to restrict a state government entity's authorized powers and duties or a local government's authority to provide the program, function, or activity that is the subject of a concern.
-Repeals the provisions of this Act on July 2, 2012 (Sec. 1).
