Title: Requiring Bicycle Helmets for Minors
Vote to pass a bill that requires individuals aged 2 to 17 years of age to wear a protective helmet when utilizing non-motorized wheeled mode of transportation on public streets and spaces open to the public beginning July 1, 2010.
-Specifies that individuals that violate the provisions of this Act are guilty of an unclassified traffic infraction, but shall not be subject to prosecution, penalty, or surcharge (Sec. 3). -Specifies that parents or legal guardians of individuals in violation of the provisions of this Act shall not be subject to any legal liability or designation of fault due to the violation (Sec. 3). -Authorizes law enforcement to enforce the provisions of this Act by stopping an individual in violation, or the accompanying adult, and inform them of the violation and provide a safety information card that explains the risks of not wearing a helmet and where to obtain a free or low-cost helmet (Sec. 3). -Requires the Department of Transportation to make available to schools information about the safe use of public streets and premises that are open to the public for non motorized wheeled transportation and pedestrians, and specifies that the curriculum shall include, but is not limited to, the following (Sec. 3):
