Vote to pass a bill that prohibits the use of a mobile communications device by a driver of a motor vehicle and establishes a $25 misdemeanor penalty for violations.

Highlights:

-Prohibits the use of a mobile communication device by a driver except in the following circumstances (Sec. 4):

-If the driver reasonably believes there is no other person in the vehicle capable of calling to report illegal activity, call for help or to prevent injury to a person or property; -In an authorized emergency or law enforcement motor vehicle if required; -When the device is permanently affixed to a motor vehicle and used by a motor carrier, public utility or cooperative pursuant to the Rural Electric Cooperative Act; -If the driver is operating an amateur radio and holds a valid amateur radio operator license; -If the driver is operating a two-way radio within the rules of the Federal Communications Commission; -While the motor vehicle is legally parked; -When using hands-free equipment; or -If driving a vehicle used for public or school transportation during business hours if required by the public or school transportation system.

-Defines a 'mobile communication device' as any wireless, two-way communication device that receives or transmits voice, text or pictures (Sec. 4). -Establishes a penalty of $25 for the prohibited use of a mobile communication device (Sec. 5). -Establishes a $2 interlock device fee to be collected upon conviction from persons convicted of operating a motor vehicle in violation of the Motor Vehicle Code, convicted of a crime constituting a misdemeanor or petty misdemeanor, or convicted of violating any ordinance punishable by a term of imprisonment (Sec. 1). -This bill takes effect immediately (Sec. 8). -This is a substitute bill sponsored by the House Committee on the Judiciary.
