July 31, 2014 Rep. Kristi Noem today helped lead Members of Congress from both sides of the aisle in passing the Reducing Regulatory Burdens Act (H.R.935). The legislation, which Rep. Noem co-sponsored, helps protect more than 350,000 pesticide users nationwide -- including cities, mosquito control districts, farmers, ranchers, forest managers, and every day citizens -- who are currently subject to duplicative regulations. "Duplicative regulations don't help make us safer; they just make it harder to keep bugs out of our food supply, manage disease-carrying pests in our community, and fight off mosquitoes," said Rep. Noem. "This bill simply streamlines the regulatory process so it's easier -- and less frustrating -- to do business in South Dakota." "Duplicative regulations cost us money and introduce new liabilities, but they also cost time, which we often don't have when trying to spray a community or field," said Perry Hofer with Doland Aerial Spraying in Doland, SD, and a representative of the National Agriculture Aviation Association. "I am very grateful to Rep. Noem for taking on this important issue and helping clear the way for us to work without jeopardizing any safety measures." H.R. 935 addresses a flawed 2009 Circuit Court decision that required pesticide users to obtain a duplicative permit under the Clean Water Act or pay a costly fine. Pesticides have long been regulated under the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA). The 2009 decision, however, made users subject to duplicative regulations and permitting under the Clean Water Act's National Pollutant Discharge Elimination System (NPDES) as well. The EPA has indicated that the NPDES extension would provide negligible environmental benefits. H.R. 935 would clarify congressional intent and eliminate duplicative regulations, so pesticide users would no longer be regulated through the NPDES and instead be held accountable through FIFRA alone.
