Rep. Capito Praises Court Ruling on Clean Water Act

U.S. Representative Shelley Moore Capito (R-W.Va.) issued the following statement today applauding the U.S. District Court for the Northern District of West Virginia's Wednesday ruling in Alt v. Environmental Protection Agency:

"The EPA has routinely trampled on the rights of West Virginians, and the court's ruling affirms that the EPA has yet again exceeded its statutory authority by threatening to fine a Hardy County farmer. Although the Clean Water Act has stated explicitly since 1987 that the EPA cannot require permits for agricultural storm water discharge, the EPA still sought to punish this farmer because rain could wash chicken litter into a stream.

"This story is one of many I've heard about overzealous federal agencies infringing on the rights of West Virginians and harming our state's economy. The agriculture industry employs thousands of hardworking West Virginians and provides an important source of tax revenue for local and state governments. I will continue to fight for West Virginia's farmers while pushing back against this administration's job-killing policies."
