Mr. LEAHY. Mr. President, if I might for a moment, we have had dozens and dozens of terrorists who have been arrested. We had the so-called Underwear Bomber, a member of Osama bin Laden's family, and many others. They were all given their Miranda warning and they wouldn't shut up. They kept talking day after day after day. It has been my experience that if they are going to talk, they are going to talk, whether they are given a Miranda warning or not. Wouldn't it be nice if we demonstrated to the rest of the world that we are not afraid of these people, and that we have the best system of justice in the world and we are going to use it? We have only had three or four convictions by military commissions in terrorism cases; we have had several hundred convictions in our Federal courts.

It is not responsible for Senators to talk about: Oh, my gosh, if we just sent them to Guantanamo. Guantanamo by itself is damaging to the United States and harms the image of the United States.

The fact of the matter is that the people we have arrested and who went through our court system will usually talk ad nauseam, whether they have been given the Miranda warning or not. So let's be realistic. It might be a nice talking point to scare people, but the people who are actually involved in prosecutions know it works.
